Service

All orders placed with Sunland Curated ("we," "us," or "our") are subject to these Terms of Service. By submitting an order -- whether via email, WhatsApp, or any written communication -- the client ("you" or "Buyer") agrees to be bound by these terms in full.

An order is considered accepted only upon receipt of our written confirmation and, where applicable, the required deposit payment. We reserve the right to decline any order at our sole discretion without obligation to provide a reason.

Any verbal agreements, estimates, or preliminary discussions do not constitute a binding order. Only written confirmations signed or acknowledged by both parties shall be deemed contractually binding.

All prices are quoted in United States Dollars (USD) unless otherwise agreed in writing. Prices are exclusive of any applicable customs duties, import taxes, or destination-country levies, which remain the sole responsibility of the Buyer.

Accepted payment methods include bank wire transfer (T/T), PayPal, and other methods mutually agreed upon in writing. All bank transfer fees are the responsibility of the Buyer. Payments must be made in full without deduction or set-off unless expressly agreed in writing.

Production will not commence, and no goods will be shipped, until all required payments have been received and confirmed. Sunland Curated reserves the right to charge a late payment fee of 1.5% per month on any overdue balances.

For custom and private-label orders, we strongly recommend a sample approval process prior to bulk production. Samples are produced to reflect the agreed-upon specifications and will be photographed in detail for your review.

Physical samples can be dispatched upon request; shipping costs are borne by the Buyer. Sunland Curated will provide detailed photographs and measurements as a standard part of the approval process, and physical dispatch is optional.

Bulk production will not begin until the Buyer provides written approval of the sample. Any modifications requested after sample approval may result in additional costs and revised lead times, which will be communicated prior to proceeding.

Minor variations in color, finish, or dimension of up to ±5% from the approved sample are considered acceptable tolerances inherent to handcrafted and factory-manufactured goods. These variations do not constitute a defect or grounds for return.

Sunland Curated offers full turnkey private-label services including logo engraving, custom packaging, branded hang tags, and bespoke product designs. All customization specifications must be submitted in writing and confirmed by both parties before production begins.

The Buyer is solely responsible for ensuring that all submitted artwork, logos, trademarks, and design files do not infringe upon any third-party intellectual property rights. By submitting artwork or designs, the Buyer warrants that they hold all necessary rights and licenses, and agrees to indemnify Sunland Curated against any claims arising from such submissions.

Custom tooling, mold creation, and packaging die-cut fees are quoted separately and are non-refundable once production has commenced. These tooling assets remain the property of Sunland Curated unless otherwise negotiated in writing.

Sunland Curated does not guarantee that custom products will comply with all regulations in the Buyer's destination market. It is the Buyer's responsibility to verify product compliance with applicable safety, labeling, and import regulations in their jurisdiction.

Estimated production lead times are provided at the time of order confirmation and are calculated from the date of deposit receipt and written sample approval (where applicable). Lead times are estimates only and are not guaranteed delivery dates.

Typical production lead times range from 15 to 45 business days depending on product complexity, order volume, and customization requirements. Sunland Curated will provide regular production updates and will notify the Buyer promptly of any anticipated delays.

Sunland Curated shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to factory shutdowns, national holidays (including Chinese New Year and Golden Week), raw material shortages, natural disasters, or government-imposed restrictions.

Orders may not be cancelled once production has commenced. Cancellation requests prior to production start must be submitted in writing; accepted cancellations will forfeit any non-refundable tooling or sampling fees already incurred.

Every order processed through Sunland Curated is personally inspected on-site by our team prior to shipment. This inspection covers product appearance, finish quality, branding accuracy, and packaging integrity.

Pre-shipment inspection photographs are provided to the Buyer as standard practice. Upon review, the Buyer may raise concerns in writing within 48 hours of receiving the inspection report. Failure to respond within this window will be deemed acceptance of the goods as inspected.

While we maintain rigorous quality standards, Sunland Curated does not conduct third-party laboratory testing unless specifically requested and agreed upon in writing. Additional testing fees will be quoted separately.

All goods are shipped from Yiwu, Zhejiang, China. Unless otherwise agreed, all shipments are made on EXW (Ex Works) or FOB (Free on Board) terms, with the Buyer responsible for all freight costs, insurance, customs clearance, import duties, and taxes from the point of origin.

Sunland Curated can assist in arranging freight forwarding and logistics coordination as a value-added service. Any freight costs arranged on behalf of the Buyer will be invoiced at cost with no markup, unless a service fee has been agreed in writing.

Risk of loss and title to goods passes to the Buyer upon handover to the carrier or freight forwarder. Sunland Curated is not responsible for delays, damage, or loss occurring during transit. We strongly recommend that Buyers arrange appropriate cargo insurance.

Delivery timelines provided by Sunland Curated are estimates based on information from carriers and are subject to change due to customs processing, carrier delays, or force majeure events. We are not liable for consequential losses arising from delayed delivery.

Due to the wholesale and custom nature of our business, all sales are final once goods have been shipped and accepted. Returns are not accepted for change of mind, market conditions, or minor variations within agreed tolerances.

Claims for defective goods, incorrect items, or significant deviations from approved samples must be submitted in writing to hello@sunlandcurated.com within 7 calendar days of delivery, accompanied by photographic evidence clearly documenting the issue.

Valid claims will be assessed on a case-by-case basis. Remedies may include replacement of defective units, a partial credit toward a future order, or a negotiated refund -- at Sunland Curated's sole discretion. We do not accept returns of goods that have been used, altered, or resold.

Claims arising from damage during transit must be directed to the carrier or insurer. Sunland Curated will provide supporting documentation to assist with such claims but bears no financial liability for transit damage.

Both parties agree to keep confidential all non-public information disclosed during the course of their business relationship, including but not limited to pricing, supplier details, product specifications, and business strategies. This obligation survives the termination of any order or business relationship.

All intellectual property rights in custom designs, artwork, and packaging created by Sunland Curated on behalf of a Buyer shall vest in the Buyer upon full payment. Until full payment is received, all such rights remain with Sunland Curated.

Sunland Curated retains the right to use general product photographs (without identifying branding) for internal portfolio purposes unless the Buyer requests otherwise in writing. We will never publish or share branded client imagery without explicit written consent.

The Buyer grants Sunland Curated a limited, non-exclusive license to use submitted logos and artwork solely for the purpose of fulfilling the agreed order.

To the fullest extent permitted by law, Sunland Curated's total aggregate liability to the Buyer arising out of or in connection with any order shall not exceed the total amount paid by the Buyer for the specific order giving rise to the claim.

Sunland Curated shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of goodwill, or business interruption, even if advised of the possibility of such damages.

Sunland Curated acts as a sourcing intermediary and does not manufacture goods directly. While we conduct on-site quality inspections, we cannot guarantee that goods will be entirely free of defects. Our liability is limited to the remedies described in the Returns & Claims section above.

Sunland Curated reserves the right to update or amend these Terms of Service at any time. The most current version will be made available upon request and will apply to all orders placed after the effective date of the amendment. Continued engagement with Sunland Curated following any amendment constitutes acceptance of the revised terms.

These Terms of Service shall be governed by and construed in accordance with applicable international commercial law principles. Where specific jurisdiction is required, the parties agree to submit to the jurisdiction of the courts of the People's Republic of China, unless otherwise agreed in writing.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between the parties with respect to the subject matter herein and supersede all prior discussions, representations, and agreements, whether written or oral.
